These Terms of Service (“Terms”) are an agreement between you and LL WIRELESS MEDIA LIMITED; a company registered under the laws of Cyprus with registration number 426873 (hereinafter referred to as “us”, “our” or “we”) and set forth the legally binding terms for your use of our website.

These Terms apply to your use of our website however accessed and/or used, whether via personal computers, mobile devices or otherwise.

Our Privacy Policy is incorporated into and subject to these Terms by reference. Please review that Privacy Policy for information about how we collect, use, and share information.

1. WHO WE ARE

LL WIRELESS MEDIA LIMITED is the owner of the current website Lifestylepop.com.

2. ACCEPTANCE OF TERMS

Agreement to the Terms. Each time that you access or use our Site you signify that you have read, understand, and agree to be bound by these Terms. If you do not agree to any of these Terms you must discontinue using the Site.

Eligibility. You must be at least 18 years old to use the Site.

Electronic Form/Communications. By accessing or using the Site you consent to having this agreement provided to you in electronic form and receiving communications from us electronically. We may contact you by e-mail or by posting notices on the Site. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirements that such communications be in writing, including renewal notices and notices about your subscription or account.

3. ACCOUNT AND CONTACT INFORMATION

Access to the Site. You do not need to make a purchase in order to access and browse some sections of the Site, but you may not be able to access all of the features of the Site unless you create an account. If you are browsing the Site and have not yet created an account or made a purchase your use of the Site will still be subject to these Terms.

Account. You can create an account by submitting the information required. You must provide accurate, current and complete information during the registration process and keep your account up-to-date at all times. Any false information may, at our option, result in a termination of your right to use our website.

Security. If you use our website you are responsible for restricting access to your account and ensuring that your computer and mobile device are free from all types of malicious content, including content that may track any data you enter. Your login ID, email address and password, together with any mobile number or other contact information you provide, form your “Account Information.” You understand and agree that you are responsible for maintaining the confidentiality and security of your password and other Account Information, and that you are solely responsible for all activities that occur on or through your account. Contacting You. When you provide us with contact information you expressly consent to our communicating with you using contact information obtained directly from you. You attest that you have the legal authority over any contact information provided to us and can provide us and/or third parties with the authorization to contact you.

4. ORDERS, PAYMENT AND CANCELATION RIGHTS

Purchasing our Products. Any terms and conditions of any offer disclosed to you when ordering is deemed part of these Terms. We reserve the right to change the fees for our products.

Billing Information. When you provide payment information to us or its authorized processor, you represent that you are an authorized user of the payment card, PIN, account or other payment method specified by you (“Payment Method”), and you authorize us to charge such Payment Method for the full amount of the transaction.

5. YOUR USE OF THE SITE

Rules of Conduct. In connection with your use of the Site you will not use the Site other than as permitted in these Terms and only for your personal use; You should not modify, translate, adapt the Site, Content (as hereinafter defined); You should not upload or input to the Site any information which contains software viruses, or any computer code, files or programs designed to interrupt, destroy or limit the functionality of the Site; You should not monitor traffic on the Site, obtain or accumulate personal information about other users, or collect or store personal data about other users; You should not copy or adapt the object code of any software, or in any way use the Site in any manner that adversely affects the performance or function or interferes with the ability of other users to access or utilize the Site or undertake any acts not expressly permitted under the Terms;

Monitoring. We reserve the right to monitor all network traffic to the Site and anyone using the Site expressly acknowledges that such monitoring may occur. We can block unauthorized attempts or intrusions to upload or change information or cause damage to the Site in any way.

Termination. We may terminate your access to our Site immediately at any time without notice, if, in our opinion, you have violated any provision of these Terms. Termination will not limit any of our rights.

Third-Party Links. The Site may contain links to other websites or applications. These websites are not under our control and the existence of a link does not imply any endorsement of or affiliation with the linked websites. We make no warranties or representations, and we disclaim liability, relating to its content.

Data Collection Policy. No party unaffiliated with us may collect or use, any data from a user, or a computer or device operated by a user.

Modification to the Website. We have the right to modify our Products and the Site at any time in our sole discretion.

6. ONLINE SHOPPING

Lifestylepop is an online marketplace for selling and buying pre-owned luxury items. Our available designers list includes top luxury brands like Louis Vuitton, Hermes, Chanel, Gucci, Dior, Balmain, Dolce Gabbana, Herve Leger, Ermanno Scervino, Zimmermann, Chloe, Miu Miu and many more. All items are offered for sale at a discount which may vary according with the specific item for sale.

We reserve the right to cancel any order, at our sole discretion, for reasons including but not limited to:

– Manifest errors in product pricing or descriptions,

– Technical issues or glitches on the platform,

– Suspicion of fraudulent activity or abuse of the website,

– Unavailability of the item,

– Force majeure or unforeseen operational circumstances.

In the event of a pricing error or listing mistake, Lifestylepop is not obligated to honor the incorrect price and may cancel the order even after it has been confirmed or paid. A full refund will be issued promptly to the original method of payment.

By placing an order, you acknowledge and accept that such errors may occur, and that shall not be held liable for any damages or losses resulting from the cancellation of an order under these circumstances.

All items are accompanied by several pictures and are categorized accordingly with their conditions as follows:

a. Never worn with tag

An item that is brand new, unworn with no flaws, bearing the original tags.

b. Never worn without a tag

An item that is brand new, unworn with no flaws, but not bearing the original tags.

c. Very good condition

A second-hand item, rarely worn and very well maintained.

d. Good condition

A Second-hand item which is well maintained.

e. Fair condition

A second-hand item which has various flaws and has been frequently worn.

Authenticity

Authenticity of all products sold through our website is of outmost importance to us and for this reason we are offering you product authentication procedures, which you can elect to use for your own benefit. While authentication is not compulsory, we recommend all customers to use it for confirming the authenticity of the products selling/buying for their protection of frequently-counterfeited, high-value items. We offer two options of product authentication procedures:

a) online authentication through LegitGrail at a cost of fifteen Euro (€15) for each procedure

b) AI authentication which will be conducted at our premises using Entrupy an objective, scientifically-proven approach at a cost of thirty Euro (€30) for each procedure except premium Hermes items which cost one hundred and twenty euro (€120) per item.

Irrespective if you the client has chosen to use an authentication procedure, Lifestylepop shall have no responsibility whatsoever for any counterfeit products that may be sold through the website. By using our website all users accept that the limit their rights in case they suspect an item is counterfeit, to returning an item, as described below under paragraph 9.

What and how to sell on Lifestylepop

We accept designer items which are unworn, in very good condition, good condition or with minor defects. All clothes should be dry-cleaned before listing. The most important thing is the authenticity of all items listed on our website, therefore the seller must be sure of the authenticity before listing.

You will be able to upload clear photos of the item you wish to sell from different angles, mention the price as well as add as much detail as you can such as colour, measurements, size, condition and any other relevant information. Authenticity proof such as label, original packaging, authenticity card etc shall be included in the photos. After you have uploaded the photos and information you wish to accompany your for sale item make sure to click the save product button so they will be saved on our website. All items/ uploaded information will be screened by our team before your listing is accepted. We will usually inform you within 48 hours if your listing is accepted.

By uploading any images you will need to declare that you legally own the item or that have the permission from the owner to upload the photos and list the item for sale. Lifestylepop accepts no responsibility whatsoever for any claim regarding ownership of a listed item. The responsibility shall always remain with the Seller.

After listing what next

a) Buyers will have the option to make an offer or purchase the item at the offered price. You may elect to accept or reject any counteroffer made.

b) Once your listing has been sold a shipping label will be issued on your name as a shipper. You will be expected to ship the sold item to the buyer within a maximum of 5 working days.

c) After the buyer receives the item, and provided no claim is raised within the three (3) day claim window and no legal withdrawal is exercised, the purchase amount will be released to the Seller **no earlier than fifteen (15) days after confirmed delivery**, minus our commission (please see table above), shipping costs (please refer to paragraph 8 below), and a processing fee up to 2%. The processing fee may change due to the market or third-party conditions. If a claim or withdrawal is raised, the payout will be withheld until the case is resolved. Buyer payments are held in escrow by the Marketplace until the transaction is finalized. The funds shall be credited to your indicated bank account following release.  We will provide you with a swift copy as soon as the transfer is made. Lifestylepop will have no responsibility if your banking institution rejects our transfer and it will be your responsibility to provide an alternative payment method.

Shipping Labels and Escrow

The Marketplace provides prepaid shipping labels through third-party carriers on behalf of Buyers. All Buyer payments are collected and held in escrow until the transaction is finalized. Sellers will receive payment no earlier than fifteen (15) days after confirmed delivery, unless a claim has been raised in accordance with these Terms. If a claim is made, the payout to the Seller will be withheld until the case is resolved. The Marketplace acts as an intermediary and is not the Seller of the goods.

7. PLACING AN ORDER

By placing an order you are offering to purchase a product on and subject to the present terms and conditions. All orders are subject to acceptance and availability, and items in your shopping basket are not reserved and may be purchased by other customers. All orders are further subject to confirmation of the order price. If your order is accepted you will receive an email notification confirming the details of your order. When placing an order, you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods.

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the selected goods will not be formed until your payment has been approved.

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If you cancel and you have already paid for the goods, you will receive a full refund.

We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time. We reserve the right to refuse to fill any orders that you may place based on information on the Website that may contain errors or inaccuracies.

Care has been taken to ensure that the photographic representation, description and specification of each product on our website is accurate. However, while the reproduction of colours is a close representation, a slight variation in the actual goods may occur. We are therefore unable to guarantee that the product images you see are an accurate representation of the actual merchandise.

8. DELIVERY

The shipping costs are as follows:

Cyprus – up to 2 kgs

a) Shipping: €5 for orders up to €200

b) Free shipping for orders over €200

For each additional kilo, the rate is 1,00€ per kilo.

Greece, Bulgaria, Romania – up to 2 kgs

Flat rate 13 euro

For each additional kilo, the rate is 3,00€ per kilo.

Rest of the EU countries plus Monaco, United Kingdom and Switzerland

a) For orders up to 1.5 kg – €35

b) If the order is between 1.5-2.5 kgs – € 50

c) If the order is above 2.5 kgs – according to weight

USA

The shipping cost will be calculated according to the weight of the item.

Notes:

We highly recommend opting for insurance coverage. The cost of insurance is 1% of the declared value, with a minimum of 10 euros.

An invalid address will cause a delay in the delivery of a shipment and incur extra shipping charges.

The customer is liable to pay the Customs & Duties (if any) levied during the clearance process and also to provide any additional documents as & if requested by the Customs Officials. We suggest that you seek Internet Assistance to get an estimate of the applicable Customs Duties & Taxes in your country.

No Duties & Taxes will be applied for a purchase within the EU countries.

Delivery times may vary depending on many factors therefore delivery times are estimates only and cannot be guaranteed. The estimated delivery date of the products may be stated in your order confirmation (if we have such notification from the courier company). Even if stated there may be circumstances where delivery is delayed because of an event beyond our control. If this happens, we will try and arrange for your products to be delivered as soon as possible, but Lifestylepop will not be liable for any delay as well as for any losses caused as a result of such delay.

Responsibility and Risk

Risk of loss remains with the Seller until the item is successfully delivered to the Buyer. Buyers may choose optional shipping insurance at checkout. If no insurance is purchased, the Seller remains liable for any loss or damage during transit. In case of loss, non-delivery, or damage by the carrier, the Seller shall refund the Buyer. The Marketplace may facilitate such refund by deducting the corresponding amounts from the Seller’s payout.

9. RETURNS, CLAIMS AND WITHDRAWAL RIGHTS

As we are a pre-owned consignment store, we do not offer returns or exchanges. All sales are final. The only case we return your money back is for suspicion of counterfeit, damaged item or significantly different from the description. In this case a claim must be made in writing within 72 hours after receipt of an item, by sending an email at [email protected]. Once your claim has been investigated and accepted by us, the object returned, we will refund the amount paid for the item.

All items sold directly from our warehouse at Lifestylepop are checked diligently prior to sale to guarantee their quality and precision therefore in case they are damaged during transit you will need to notify us as soon as the item is received at [email protected] and to send the purchased item back within two working days from its receipt.

Once your return has been received and accepted your refund will be processed to your original payment method. Refunds can take up to 10 days to show in your account, depending on your payment provider.

All returned items will need to be dispatched to the following address:

9.1 Three-Day Claim Window

The Buyer must inspect the item upon receipt. If the item is counterfeit, damaged, not authentic, or significantly different from the description, the Buyer must file a claim via email at [email protected] within three (3) days of delivery. After this period, the transaction is considered accepted, unless the Buyer exercises the legal right of withdrawal described in 9.2.

9.2 Legal Right of Withdrawal

In accordance with EU consumer protection law (Directive 2011/83/EU as transposed in Cyprus), Buyers purchasing from professional Sellers are entitled to a legal withdrawal right of fourteen (14) days from the date of delivery, during which they may return the item without providing any reason.

This right does not apply to purchases made from private Sellers, only from professional Sellers within the Marketplace. 

9.3 Exceptions to Withdrawal Right

The 14-day withdrawal right does not apply in the following cases, in line with EU law:

– Goods made to the Buyer’s specifications or clearly personalized items.

– Sealed goods which are not suitable for return due to health protection or hygiene reasons, once unsealed (e.g. lingerie, swimwear, underwear).

– Pierced jewellery such as earrings, once the hygiene seal is broken.

– Goods which are liable to deteriorate or expire rapidly.

– Newspapers, periodicals or magazines.

9.4 Refund and Shipping costs 

Refunds shall include the purchase price and the initial shipping costs paid by the Buyer. Refunds must be processed within 14 days of the withdrawal notice or acceptance of a claim.

  • In case of simple withdrawal, the Buyer bears the cost of return shipping.
  • In case of counterfeit, non-conformity, or damaged goods, the Seller bears the cost of return shipping and must fully refund the Buyer.

(a) *Statutory Withdrawal Right (Professional Sellers Only) *  

In accordance with EU consumer law (Directive 2011/83/EU as transposed in Cyprus), Buyers purchasing from *professional Sellers* have a legal right to withdraw from the purchase within fourteen (14) days of delivery, without providing any reason.  

In this case:  

– The Seller shall refund the purchase price and the initial shipping cost (Seller → Buyer).  

– The Buyer shall bear the cost of the return shipping (Buyer → Seller).  

(b) *Private Sellers (Non-Professional)*  

Purchases made from *private Sellers* are strictly final sale. No withdrawal right applies. Returns are accepted only in cases listed under section (c).  

(c) *Returns for Non-Conformity or Seller Error*  

Irrespective of whether the Seller is private or professional, returns will be accepted only if:  

(i) the wrong item has been shipped,  

(ii) the item’s condition materially differs from the description and photographs on the Website, or  

(iii) the item is counterfeit or not authentic.  

In such cases:  

– The Seller is fully responsible for all costs.  

– The Seller shall refund the purchase price, the initial shipping cost (Seller → Buyer), and the return shipping cost (Buyer → Seller).  

(d) *Final Sale Policy*  

Except for the situations expressly mentioned above, *all sales on LifestylePop are final and no returns will be accepted*.

9.5 Process

All returned items must be shipped to the following address unless otherwise agreed:

Refunds can take up to 10 days to show in the Buyer’s account, depending on the payment provider.

10. CREDIT CARD PAYMENTS

We accept payments through all major credit cards. All international transactions are converted to EURO and at the time of making the purchase, by default you will be charged in EURO.

Payment will be debited and cleared from your account upon dispatch of your order. All payments and the card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to us we will not be liable for any delay or non-delivery.

We take reasonable care to make our Site secure. All credit/debit card transactions on this site are processed using a secure online payment gateway. If you are registered with us, we will securely store your credit/debit card details on our systems. These details will be fully encrypted and only used to process card transactions which you have approved such transaction.

We take reasonable care, in so far as it is in our power to do so, to keep your details and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from our website.

12. PROPRIETARY RIGHTS

Ownership of Content and Marks. The Site and all content published on or accessible through the Site is owned by us and is protected by laws governing copyrights, trademarks and/or other proprietary rights. You acknowledge that you do not acquire any ownership rights in the Site. You agree not to copy, reproduce, publish, transmit, distribute, perform, sell, or in any way exploit, the Site, or Content, in whole or in part, without our prior written consent.

Our Limited License to You. You acknowledge and agree that the Site and Content are provided under license, and not sold, to you and your use. You do not acquire any ownership interest or any other rights thereto other than to use the Site and Content in accordance with the license granted, and subject to all terms, conditions, and restrictions under these Terms. We grant you a limited, personal, non-commercial, non-exclusive, revocable, non-assignable, and non-transferable license to access and display the Content for your personal use in connection with accessing and using the website as reasonably necessary to use them for their intended purpose.
